Austin's first environmental lawsuit aims to retain public access to Barton Creek threatened by development on the part of private landowners. It was ultimately unsuccessful.
If the court rules Barton Creek a navigable stream, a public easement must be granted for recreational purposes, according to Texas law.
I think it is a capricious suit which may satisfy someone's desire for publicity, but I don't think it's doing this community, the landowners or the general public any good.
